Please read these contest rules prior to subscribing to the Dawn M. Wayand Arts bi-monthly Newsletter and participating in the Monthly Prize Drawing.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in the plural.
Definitions
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to NYC Digital Photography Workshops LLC d/b/a Dawn M. Wayand Photography, 26 Palmer Avenue, Apt. 1A, Bronxville, NY 10708.
- Contest Rules mean these Contest Rules that form the entire agreement between You and the Company regarding the subscription to the Dawn M. Wayand Arts Newsletter.
- Monthly Prize Drawing shall mean that one (1) email address will be picked at random each month and the winner will receive the option to choose an art print from a list of available art prints – the size which is determined by the Company and described on the Dawn M. Wayand Arts Newsletter Subscription signup section of the homepage of the Website.
- Newsletter refers to the bi-monthly digitally distributed Dawn M. Wayand Arts Newsletter.
- Prize shall mean a choice of out of select art prints as listed on these Contest Rules and the size as described on the Dawn M. Wayand Arts Newsletter Subscription signup section of the homepage of the Website.
- Promotions refer to contests, sweepstakes, or other promotions offered through the Service.
- Service refers to the Website.
- Subscription shall mean the distribution of the bi-monthly digital subscription to the Dawn M. Wayand Arts Newsletter which will be sent by email to the email address registered when subscribing to the Newsletter.
- Website refers to Dawn M. Wayand Arts, accessible from https://art.dawnmwayand.com
- You means the individual accessing or using the Service, signing up for a Subscription or participating in the Monthly Prize Drawing, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, signing up for a Subscription or participating in the Monthly Prize Drawing, as applicable.
Acknowledgment
These are the Contest Rules governing the participation in the Monthly Prize Drawing through a Subscription to the Dawn M. Wayand Arts Newsletter, and the agreement that operates between You and the Company. These Contest Rules set out the rights and obligations of all users regarding the participation in the Monthly Prize Drawing through a Subscription to the Dawn M. Wayand Arts Newsletter.
Eligibility to participate in the Monthly Prize Drawing is conditioned on Your acceptance of and compliance with these Contest Rules. These Contest Rules apply to all visitors, users, and others who sign up for a Subscription to the Dawn M. Wayand Arts Newsletter if You choose to participate in the Monthly Prize Drawing.
By signing up for a Subscription to the Dawn M. Wayand Arts Newsletter, You agree to be bound by these Contest Rules if You choose to participate in the Monthly Prize Drawing. If You disagree with any part of these Contest Rules then You may not be eligible to participate in the Monthly Prize Drawing or to win a Prize.
You represent that you are over the age of 18. The Company does not permit those under 18 to sign up for a Subscription to the Dawn M. Wayand Arts Newsletter or to participate in the Monthly Prize Drawing.
Your Subscription to the Dawn M, Wayand Arts Newsletter and participation in the Monthly Prize Drawing is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before signing up for a Subscription to the Dawn M. Wayand Arts Newsletter or participating in the Monthly Prize Drawing.
Rules
- Monthly Prize Drawing is open to U.S. residents only at this time.
- Only one winner will be chosen per calendar month.
- Drawings will be held on the first calendar day of each month.
- Winners will be notified by email after the drawing and provided a list of art prints to choose one (1) art print from for their Prize.
- Winners have seven (7) calendar days to respond to the Company’s email with the selection of their Prize otherwise they forfeit their Prize.
- Prizes will be shipped out within ten (10) calendar days from the date of selection of the Prize by the winner.
- Winners must notify the Company of their preferred U.S. shipping address for their Prize in the email in which they select their Prize.
- The Company will not be responsible for lost, damaged, or stolen Prizes in the process of delivery to the preferred U.S. shipping address.
- Winners from drawings are only eligible to participate in the Monthly Prize Drawing to receive a Prize every six (6) months.
- The Company may choose to close the Monthly Prize Drawing Promotion at its sole discretion at any time.
