The following terms are applicable for any Goods that You purchase with Us.
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following terms and conditions. The following definitions shall have the same meaning regardless of whether they appear singular or plural.
Definitions
For this Return and Refund Policy:
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) shall mean NYC Creative Productions LLC d/b/a Dawn M. Wayand Arts, 92 Hamilton Avenue, #5E, Yonkers, NY 10705.
- Goods (referred to as either “Goods”, “Products” or “Artwork” in this Agreement) shall mean the products offered for sale on the Service.
- Order shall mean a request by You to purchase Goods from Us.
- Service shall mean the Website.
- Website shall mean Dawn M. Wayand Arts, accessible by https://art.dawnmwayand.com or any subpage thereof.
- You (referred to as either “You” or “Your” in this Agreement) means the individual accessing or using the Service; or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Order Cancellations
We accept cancellations only within 48 hours after the order has been placed. To cancel your order, you must notify Us by calling Us at +1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND email us at art@dawnmwayand.com with the following required cancellation information:
- Order number
- Your full name
- Shipping address
- Phone number
- Email address
- The title(s) of the Artwork(s) purchased
- The reason for your cancellation request
Order cancellations received after 48 hours from the purchase date and time can no longer be canceled. Please see our Returns Policy for more information.
Returns Policy
You have three (3) days* after the delivery of the Artwork to You (as shown by proof of delivery by the service carrier) to decide whether to keep the Artwork or return it in its original condition for a refund**. Please notify the Company of your intent to return by calling Us at +1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND email us at art@dawnmwayand.com with the following required return information:
- Order number
- Your full name
- Shipping address
- Phone number
- Email address
- The title(s) of the Artwork(s) purchased
- The reason for your return request
We require all returned Artwork to be shipped by You to the Company within three (3) days after notifying Us at + 1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND by email at art@dawnmwayand.com that the Artwork will be returned. The Artwork MUST be shipped through a traceable shipping carrier and you must provide the Company the shipment’s tracking number.
If you do not notify Us of Your intent to return the Artwork within three (3) days after the delivery of the Artwork to You (as shown by proof of delivery by the service carrier) and You do not ship the Artwork within three (3) days of notifying Us at +1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND by email at art@dawnmwayand.com, You will not be eligible for a refund.
* The three (3) day return policy does not apply to Artwork that was received damaged by the carrier service. For Artwork that was received damaged, you MUST contact the Company at +1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND email us at art@dawnmwayand.com (with the same return information above) WITHIN 24 HOURS after the delivery of the Artwork to You (as shown by proof of delivery by the service carrier) for return information from Us. (See more about “Artwork That Arrived Damaged” below)
** Conditions apply for returns of undamaged Artworks (see “Conditions for Returning Undamaged Artworks” below).
Conditions for Returning Undamaged Artworks
For an Artwork to be eligible for a return, the following conditions must be met:
- The Artwork was delivered to You within the last three (3) days (as shown by proof of delivery by the service carrier).
- The Artwork was not used or damaged and must be received back by the Company in the same condition as it was when it was shipped to You by the Company.
- Returned Artwork must be shipped back to the Company by You in appropriate packaging, ideally, its original packaging, therefore it is important to take care when unpacking received Artwork. If you have already disposed of the original packaging, you will be responsible for purchasing packaging materials to send the Artwork back safely to the Company. Please refer to our Artwork Packaging Guidelines for instructions on safely shipping Artwork for shipment.
- You have the receipt or proof of purchase.
- You notified Us within three (3) days after the delivery of the Artwork to You (as shown by proof of delivery by the service carrier) of your intent to return by calling Us at +1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND email us at art@dawnmwayand.com with all the required return information as listed above.
The following Artworks cannot be returned:
- The supply of custom Artwork made to your specifications (such as commissioned Artwork) or personalized Artwork.
- Artworks on sale. Only regular-priced Artwork may be refunded.
- Artwork that has been used, modified, or damaged by You.
- Orders for which VAT/DUTY charges are not paid.
Artwork That Arrived Damaged
For an Artwork that was delivered damaged to You, the following terms and conditions apply and you MUST follow the following steps for return and refund:
- Within 24 hours after the delivery of the Artwork to You (as shown by proof of delivery by the service carrier), you MUST contact the Company at +1 (347) 598-0972 between the hours of 10:00 a.m. to 6:00 p.m. EST seven days a week AND email us at art@dawnmwayand.com with the following information:

- Your full name
- Shipping address
- Phone number
- Email address
- The title(s) of the Artwork(s) purchased that were received damaged
- Clear and detailed photos of the Artwork shipping package before opening it as well as clear and detailed photos of the damaged Artwork for insurance purposes and also so that the Company can learn more about what went wrong with Your particular shipment
- Save the original packaging.
- The Company will contact you to discuss the next steps for the return and refund.
Refunds
Once the Artwork is safely delivered back to the Company, the shipped package will be photographed before opening and then it will be video recorded while being opened and inspected to determine if the return meets the conditions of “Returning Undamaged Artwork” or returning “Artwork That Arrived Damaged”. If the return is accepted and the refund is approved, you will receive a confirmation email that the returned item has been received and that a refund will be processed, as applicable, back to the original form of payment used to purchase the Artwork, in the same currency and using the same exchange rate as your original order (minus shipping costs and fees, if any, and if applicable) within 7-10 business days of receipt by the Company of your Artwork return.
Shipping Costs
The Company does not refund the outgoing or return shipping charges or costs (including customs) unless the return is due to one of the following reasons:
- The Artwork arrived damaged (in which case a refund of shipping costs can only be received if ALL steps provided in “Artwork That Arrived Damaged” are followed above)
- The Artwork canvas size dimensions or materials used for the artwork were inaccurately described on the website
The Company does not refund outgoing or return shipping costs for Artwork returned based on the return reason of color variations between the images on the Website and the Artwork received. Please see Color Disclaimer for more information.
The Company does not refund outgoing or return shipping costs for Artwork returned due to a collector changing their mind or no longer wanting the Artwork purchased (buyer’s remorse).
Where to Ship Returns
You are responsible for the risk of returning Goods to the Company, therefore, be sure to insure your return packages. You should send approved return Goods to the following address:

We cannot be held responsible for Goods damaged or lost in return shipment and will not issue a refund for Goods damaged or lost in return shipment. Therefore, We recommend an insured and trackable courier service. We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.
Additional Return Disclaimers
- The Company is not responsible for undelivered returns to the Company, therefore You must use a reliable return-shipping carrier such as (UPS, FedEx, or DHL) with traceable shipping tracking information. If the Company does not receive your returned Artwork and the returned Artwork is not in compliance with the terms and conditions stated above, it will not grant a refund.
- Returns and refunds are not applicable for Orders for which the VAT/DUTY charges are not paid.
